Do Owner-Operators Need a DOT Consortium?

If you drive a commercial motor vehicle under your own authority, you are your own employer and still must be in a DOT random drug and alcohol testing program. Here is how that works.

Short answer: yes. Owner-operators with a CDL who drive a commercial motor vehicle under their own authority are covered by the DOT drug and alcohol testing rules. Being both the company and the driver does not exempt you.

In one sentence: a solo owner-operator cannot run a valid random testing pool alone, so you join a consortium (C/TPA), which pools drivers from many companies and runs the random selection for you.

Why you still need a program as a one-person company

The FMCSA requires every employer of CDL drivers to have a random drug and alcohol testing program. When you own the truck and drive it, you are the employer and the employee. The random selection must be unannounced and based on a scientifically valid method. One driver cannot pick themselves randomly, so you join a larger pool.

The FMCSA minimum annual random testing rates are 50% for drug tests and 10% for alcohol tests, applied across the pool. That does not mean you are tested half the time. In any year you may be selected once, more than once, or not at all.

Can I be my own random testing program?
